The district consumer disputes redressal Forum, Erode had ordered a penalty of 10.76 lakhs to Maruthi Medical Centre, Erode for deficiency in service and medical negligence for the family members of a 49 year old person who died following a negligent treatment.

A complaint was submitted by Mrs. M. Shanthi that her husband, P.S.Mohan, field officer in Jupiter security Service, sustained serious injuries when the rear tyre of his 2 wheeler got punctured and he fell down. His X Ray report taken at Erode ortho centre suggested immediate surgery. But before the surgery, his condition worsened. He developed unbearable pain and died.

Mrs. Shanthi and her sons suspected that he died due to wrong administration of an injection without giving a statutory test injection. Her petition to the hospital did not find favour.

Denying the allegation the hospital said that it was an ISO certified hospital, approved by both central and state governments. The hospital further said that the patient died due to myocardial infarction an CAHD uncontrolled systematic hyper tension. Dr. Senthil Raja who was the consultant, it was informed, was not a staff of that hospital

When the case was taken by the CDRF, Erode they contended that the patient was treated only in the OP and was not admitted as in patient.

The bench of the forum did not accept the version of the director Dr. Sadasivam and held that Dr. Senthil raja was responsible for the death of Mr. P.S. Mohan. A compensation of Rs.10.76 Lakhs was ordered to be paid to Mrs. Shanthi.
