A doctor who survived a potentially serious accident due to the malfunctioning of his car has been awarded a compensation of Rs. 5 lakh, plus costs.

Dr. Nitin Dange, a neurosurgeon, submitted to the State Consumer Disputes Redressal Commission that he was on his way to attend an emergency call from a hospital when the brakes and steering wheel of his Honda City car got jammed. Because he was travelling very slowly on account of the fact that it was raining, he was able to guide the car towards the median on the road. The car hit the median and flipped over.

Dr. Dange survived the crash despite the airbags of the car not inflating.

The complainant submitted that the car was less than a year old at the time of the mishap, and was in fact had been freshly serviced.

He submitted that it had been pointed out to the service centre, Shaman Cars Ltd., that there was a problem with the brakes, yet it had not been attended to.

He sought replacement of the vehicle.

While the Commission declined to accede to his plea for the vehicle to be replaced, it awarded him the compensation, to be jointly paid by Honda Cars India, Shaman Cars India and Arya Honda, in view of the fact that there had been a lapse on the part of the authorized service agent, which had ultimately resulted in the accident.
Dr. Dange was also awarded Rs 25,000 as costs.
