In yet another judgement against the DLF Southern Homes pvt Ltd of New Delhi, the forum has fined them Rs.55,000/- for deficiency in service.

M/s Jayanthi and Sridhar of Besant Nagar at Adyar paid Rs.4 lakhs in January 2008, to book an apartment with DLF in its “Garden with complex” at OMR. The price of the apartment was Rs.40 Lakhs.

Until 2009, there was no progress. As per the agreement executed in 2009, DLF was to hand over the apartment in 27 months by December 2011. It also promised a discount of Rs.200 per sq.ft, as Timely Payment Rebate(TPR). The buyers paid another 38 lakhs in six instalments and the balance had to be paid after the occupation certificate was provided.

But the apartment was not handed over in time, nor any rebate, as promised, was forth coming.

When the consumer issued a legal notice, DLF wanted more money, due to increase in Vat and service charges. The consumers complaint was heard by CDRF north Chennai.

The builder alleged, that the payment was not made within time stipulated and hence consumer was not entitled for rebate. They further said that the apartment was handed over in 2014, after the complaint was ifled in CDRF.

They also contended that the sale deed would be given only an receipt of balance amount.

The CDRF found that except for an amount of 4.05 lakhs which was paid in time there was a delay of 14 months on the part of DLF which necessitated payment of compensation as agreed. The bench also ordered the builder to register the undivided share of land in favour of the consumer.
