Puducherry, February 2016: The State Consumer Disputes Redressal Commission here has found an anaesthetist guilty of medical negligence, and ordered compensation of Rs. 15 lakh to be paid to the family of a patient who died after a botched gallbladder surgery.

The Commission was disposing of an appeal filed by the bereaved family, on an order passed by the District Forum favouring the specialist, the anaesthetist and the private nursing home.

According to the complainants, Kanniakumar was admitted to the private nursing home to undergo surgery to remove gallbladder stones. They were told that the surgery would be completed in an hour. The specialist and anaesthetist were present in the theatre. After two hours, they were told that the patient had developed cardiac problems, and a cardiologist was called in. However, the cardiologist reported that the patient had died long before he was called.

The Commission held that the managing director of the nursing home could not be held responsible, as he had only leased out a portion of his building to the urology clinic. Also, from the evidence presented, the Commission concluded that the patient had collapsed even before the specialist could begin his work. Therefore, the specialist too was exonerated.

The Commission held that the patient had no other health problems as per his medical records, and that it was a case of a simple anaesthetic procedure having gone wrong because of the “lackadaisical attitude of the anaesthetist. We have observed that two failed intubations, hypoxia and also plenty of medicines were pumped into the body of patient. When everything failed, tracheotomy was also done. Finally, it was beyond the control of the concerned doctor to save the life. Thus, the lapse on the part of anaesthetist amounts to medical negligence.”
